Terms and Conditions of Online Shopping

These terms and conditions apply to purchases made on this web site from 
www.gaudions.com.au.

All orders placed through this website are subject to confirmation and acceptance 
by Gaudion Furniture. All prices are in Australian dollars and include GST

Gaudion Furniture may vary prices, in the event of price changes or mistakes made by suppliers on reasonable prior notice to you. If Gaudion Furniture requests payment for increased prices, you may cancel the order by giving notice to Gaudion Furniture, which must be received within seven days of the announcement of the increase.

Orders and delivery


Gaudion Furniture or its agent will deliver the goods you order to the address you specify in your order, within the agreed time frame, subject to their availability. Where the goods are not available, you will be notified of this by Gaudion Furniture as quickly as possible. Anyone at the delivery address who receives the goods will be presumed by Gaudion Furniture to be authorised to receive the goods. You must ensure that a person over that age is available to accept delivery of the goods. If there is no-one at the delivery address or no-one of appropriate age to receive the order, Gaudion Furniture may charge you additional delivery fees. Once the goods are delivered to you, you will own them and it is your responsibility if they are lost or damaged.

Delivery and Shipping

Delivery costs for small items are automatically calculated through Australia Post and charged to your account. Any items marked as bulky or outside the Australia Post guidelines, will be charged accordingly to size, weight and destination. These deliveries will be made Monday to Friday. 

If there is no one available to receive the parcel Australia Post will leave a card with pick up information. The parcel can then be picked up at the local post office during their normal opening hours. 

Returns and Replacements

In the event that an item is flawed or damaged upon delivery please contact  us as soon as you receive it to discuss a return and replacement.

The returned items must be in new, unused, condition and in its original packaging.
Any postage shipping charges for the return of the item are your responsibility. 
**Please note custom made ordersand special order, fabrics, curtains, wallpapers, pictures, rugs and sale items cannot be returned, exchanded or refunded.

Prices and payment


For each online order, you must pay: 
the applicable price for the relevant goods confirmed by Gaudion Furniture; a message card if desired; and the delivery and handling fee specified on the web site at that time.

Your order and credit card details are safe and secure. All personal and credit card information provided to Gaudion Furniture is encoded using Secure Sockets Layer (SSL) technology, an encryption protocol that protects data as it travels over the internet.

At this stage, we can only accept payments using the methods stated in the Orders and Payment section of this web site. We are unable to accept COD charges. Payment must be cleared before the goods are despatched. Prices and range on this web site may vary from Gaudion Furniture commercial sales pricing.

Your account 


You agree to take responsibility for the safekeeping of your email address. You are liable if your email address is used by an unauthorised person. You agree to release and indemnify Gaudion Furniture in connection with any use (whether authorised or unauthorised) of your email address. Gaudion Furniture may suspend or cancel your account at any time without prior notice.

Pictures


Gaudion Furniture aims to include up-to-date pictures of all of the goods on this web site. We have made every effort to display the true colour of the item, but this may vary due to computer settings, etc. Please contact us if you want to check colour. 
We recommend you read the labels on the goods carefully before using the goods. 



Privacy


Gaudion Furniture will comply with Gaudion Furniture’s Privacy Statement. Gaudion Furniture will not reveal your personal information to external organisations except for the purposes of fulfilling your order. 



Liability


Any liability of Gaudion Furniture in connection with goods or services supplied to you will, subject to any non-excludable liability for breach of conditions or warranties implied by legislation and to the maximum extent permitted by law, at the election of Gaudion Furniture be limited to:

  1. in relation to goods, the replacement of the goods or the supply of equivalent goods; and
  2. in relation to services, the supplying of the services again or the payment of the cost of having the services supplied again.

Changes to terms 


Each order is governed by the terms and conditions current when the order is placed. Gaudion Furniture may add to, delete or otherwise change these terms and conditions without notice. It is your responsibility to read and understand these terms and conditions each time you place an order.

Applicable law 


All purchases under this web site and these terms and conditions are subject to the laws of New South Wales, Australia.

Credit cards


At present we are not able to accept web payments made with a non-Australian credit card, given the limitations that we face in establishing that the user of the card is legitimate. Payments from overseas customers are accepted via electronic funds transfer.

Payments


Payment is expected upon collection or in advance of delivery. Identification may be requested when collecting goods. Payment details shall be finalised prior to despatch unless you have an approved account. 
Please do not use PO box numbers as your delivery address. 



Cheques
We accept company, bank or personal cheques only by prior arrangement. Cheques are not cleared funds and goods will not be despatched until the cheque is cleared by the issuing bank. Cheques are subject to clearance delay, normally three business days. 
(Gaudion Furniture, at its discretion, reserves the right to refuse payment by cheque.)

Delivery address and contact details


When placing an order with us, where we are to deliver goods to you, we require a physical street address. To assist us in processing your order, please provide your land-line phone number. Delivery is via courier and cannot be to a post office box. Please note that an authorised signatory needs to be at the delivery address to sign for and collect the goods.
